Welcome to Heyzeke, a productivity app designed to help users manage tasks, set goals, and engage with others for accountability. By downloading and using Heyzeke, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you must refrain from using our app.

1. Acceptance of Terms
By creating an account, accessing, or using Heyzeke, you confirm your agreement to these Terms and Conditions, as well as our Privacy Policy, which is incorporated by reference.

Heyzeke is available to individuals who are at least 13 years old. By using the app, you confirm that you meet this age requirement. Users under 18 must have the consent of a parent or guardian.
3. User Account
3.1. Account Creation
To access Heyzeke’s features, you will need to create an account. You agree to provide accurate and up-to-date information and to keep it updated. You are responsible for safeguarding your account credentials and agree to notify us immediately if you suspect unauthorized use of your account.
3.2. Account Security
You are responsible for all activities that occur under your account. Heyzeke will not be liable for any losses or damages caused by unauthorized use of your account.
4. User Responsibilities
You agree to use Heyzeke only for lawful purposes and in compliance with all applicable laws and regulations. Specifically, you agree not to:
Post, share, or otherwise make available any content that is unlawful, defamatory, abusive, obscene, or otherwise objectionable.
Engage in activities that could disrupt or negatively impact the operation of Heyzeke or its users.
Attempt to gain unauthorized access to any part of Heyzeke, other user accounts, or any system or network associated with the app.
5. License Grant
Heyzeke grants you a limited, non-exclusive, non-transferable license to use the app on a device that you own or control. This license is granted for personal, non-commercial use only.
6. Intellectual Property
All content, features, and functionality available on Heyzeke—including text, graphics, logos, icons, images, and software—are the property of Heyzeke or its licensors and are protected by copyright, trademark, and other intellectual property laws. You agree not to copy, modify, distribute, or create derivative works of any part of Heyzeke without prior written consent.
7. Subscription and Payment Terms
Heyzeke may offer certain features or services on a subscription basis. By subscribing, you agree to pay the applicable fees in accordance with the subscription terms and authorize us to charge your payment method for the subscription.
7.1 Cancellation and Refunds
You may cancel your subscription at any time. If you cancel during an active subscription period, you will still have access to paid features until the end of the period, but no refunds will be provided.
7.2 Changes to Fees
Heyzeke reserves the right to change subscription fees at any time, with prior notice to you. Continued use of the app after any fee changes indicates acceptance of the new fees.
8. Limitation of Liability
Heyzeke is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Heyzeke disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. Heyzeke does not guarantee the accuracy, reliability, or completeness of any content provided on the app.
In no event shall Heyzeke, its affiliates, or licensors be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data, arising out of or in connection with your use of the app.
9. Termination
We reserve the right to suspend or terminate your account and access to Heyzeke, with or without notice, for any reason, including but not limited to your violation of these Terms and Conditions or any applicable law.
Upon termination, your right to use Heyzeke will cease immediately. If you wish to terminate your account, you may do so by contacting help@heyzeke.com
10. Modifications to the Terms
Heyzeke reserves the right to modify these Terms and Conditions at any time. We will notify you of any material changes by posting the new Terms and Conditions on this page or, where appropriate, through in-app notifications. Continued use of the app following any such changes constitutes acceptance of the new terms.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Montreal, Quebec, Canada without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Montreal, Quebec, Canada.
